Texas Court ruling keeps Cliffside helium operations under receivership

The Texas Court of Appeals has dismissed Air Products Helium’s appeal against the 108th District Court’s decision to place Cliffside Refiners (CRLP) under receivership.

Made by the court on 9th January, the news follows a ruling on 30th December that allowed the receivership to proceed and rejected Air Products’ request to halt it.

The court-appointed receiver will oversee CRLP’s operations, including Messer Helium Cliffside’s (MHC) management of the Crude Helium Enrichment Unit (CHEU) at the former Federal Helium System near Amarillo, Texas.

No further interlocutory appeals of the receivership are available to any parties.

The CHEU is the critical machinery that extracts and processes helium from the system. Messer has previously expressed concerns that Air Products’ actions could prevent numerous third parties from accessing their privately-owned helium stored within the Federal Helium System.

MHC will work with the receiver to secure long-term, uninterrupted operation of the helium system, and remains open to proposals from CRLP’s partners.
