Having spent more than three decades as a lawyer for a number of companies in the industrial gas business, both global and local, when it comes to risk allocation my advice has always been the same — avoid expensive legal problems.
To minimize problems, I suggest following these three principles: be safe in what you do; do it with adequate insurance to the extent possible; and have lawyers draft appropriate contract language where it can be done.
